"Barriers have been broken in the face of xenophobia and the reconsideration of the rule of law"

On 26 January, Emmanuel Macron promulgated the law "to control immigration and improve integration". The day before, the Constitutional Council had inflicted a serious blow on the government and the members of parliament who had voted for the law, ruling that nearly 40% of its content was unconstitutional. However, this decision is a relief in disguise, as the magistrates did not rule on the substance of most of the measures, but only censured the form, considering that they had no direct relationship with the initial bill.

They thus leave the door open for these provisions, directly derived from a xenophobic ideology, to resurface through new legislative proposals. This is exactly what the Centrist Union group and, soon, The Republicains (LR) are trying to do with a bill tabled in the Senate at the end of January that includes some of the worst censored measures.

On the other hand, the court ruled that other measures in the government's initial text, which were harmful to the lives and rights of foreign nationals, complied with the Constitution. Worse still, it did not issue an opinion on the constitutionality of more than forty extremely worrying measures in the law. This is the most repressive legislation since 1945. The measures, some of which are already in force, represent a clear increase in the repressive arsenal available to prefects, and will keep thousands of people in ever greater precariousness.

Progressive dismantling

The repressive aspect of the initial bill, which was already worrying, has now been tightened up: condition of "respect for the principles of the Republic" for obtaining or renewing a residence permit, reinforcement of the double penalty, removal of protection against obligations to leave French territory (OQTF), including for spouses or parents of French nationals, use of the threat to public order, lengthening the waiting period to access the liberty judge in waiting zones and administrative detention centres, lengthening the enforceable period of OQTFs, the duration of house arrest and re-entry bans, creating a file of delinquent foreign minors and excluding young people under OQTF from child welfare.

In terms of violence and scale, all these measures constitute an unprecedented attack on the rights of foreign nationals.

Furthermore, the law contains a progressive dismantling of the asylum system. The end of collegiate decision-making at the National Court of Asylum, the facilitation of the refusal or withdrawal of material reception conditions, the possibility of detaining people before registering their asylum application, the quasi-automatic issuing of OQTFs as soon as their application has been rejected; all are measures aimed at undermining our reception system for people seeking protection in France.

The government announced a "balanced" text, between humanity and firmness. Only the second intention remains, while the integration aspect of the law has been reduced to shreds. The government is no longer hiding its desire to resort to selective immigration, looking for available labour that can be "consumed" according to the needs of our society.

Barriers have been broken in the face of xenophobia and the reconsideration of the rule of law. The spirit of this law and of the majority The spirit of this law and most of the measures introduced by the government or resulting from amendments by the Republicans, adopted with the support of the National Rally celebrating an "ideological victory", are incompatible with a humanist society.

A fatal game

Since March 2023, the parliamentary scrutiny of this text has been used to justify the most hateful and racist speeches, but also those calling into question the founding elements of our democratic system. Because some of their political proposals would be incompatible with international conventions, European treaties and our Constitution, the right and far right have asserted the need to reform our system of hierarchy of norms in order to derogate from these obligations and commitments.

All of these protective texts guarantee effective respect for human rights and the dignity of everyone on our territory, and should never be revised with the aim of taking rights away from some people. However, the government has played this fatal game by deliberately passing a law containing unconstitutional provisions.

Barriers have been broken. The consequences will be difficult to repair. The government does not seem to want to commit itself to rebuilding them, as shown by the announcements on the future regulation of state medical aid or the constitutional reform on the "droit du sol" (right of birthplace) in Mayotte. France's unconditional support for the dangerous European Pact on Migration and Asylum is another deleterious signal.

We will not give up and will continue to fight for a humanist society that welcomes everyone, protects everyone, whatever their administrative status, and ensures that human rights are unconditionally respected.

Migration will continue, whether or not there are legal pathways for processing applications. Dignified reception policies for all, even if they require political courage, would be a more sustainable solution for respecting the rights of exiles and for society as a whole.
